DIFFERENCE BETWEEN IMPORT EXPORT CODE (IEC) AND IMPORT LICENSE

DIFFERENCE BETWEEN IMPORT EXPORT CODE (IEC) AND IMPORT LICENSE

An import export code is a unique number allotted by the regional office of the director general of foreign trade (DGFT) to an applicant who wish to undertake any export or import activity. In business circles it is known as “Import Export Code, IE Code or IEC”. The IEC is a pan-based registration of persons with the DGFT and remain valid unless it is cancelled or surrendered. In other words, no person can start an Export or Import business unless an IEC is allotted and is valid. Difference between Import Export Code and Import License

Following are the features of an Import Export code / IEC

  1. An IEC is a 10-character alpha-numeric number allotted to a person that is mandatory for undertaking any export/import activities
  2. The IEC is a Pan Based Number
  3. Only one IEC is allotted against one PAN Number
  4. The entire process of allotment of IEC is online
  5. In some cases, clarification may be filed in offline mode
  6. The application for IEC can be made only through digital signature
  7. No export or Import can happen without IEC
  8. IEC is a unique identification of the importer or exporter with the DGFT
  9. IEC code is always valid unless cancelled or surrendered.

Whereas the “License for Export or Import” is a permission from central government to undertake any activity of import or export in goods which is restricted. There are certain items which is not freely allowed to be imported in India as the government can impose restriction on their import to India. Following are the general principles based on which DGFT through a Notification imposes restrictions on the import of certain items. Difference between Import Export Code and Import License

  1. For protection of Public Morals
  2. To Protect life and health of human, animal and plants
  3. To safeguard Intellectual Property Rights
  4. For prevention of prison labour
  5. To protect artistic, historic or archaeological Value of National Treasure.
  6. To conserve natural resources
  7. To discourage and limit traffic in arms, ammunition and war related items
  8. Relating to export or import of Gold or Silver

In general, the export or import is freely allowed for all items except the regulated items as declared and notified by the central government from time to time. There are three categories of items which are regulated

  1. Prohibited Items for Import and Export from India
  2. Restricted Items for Import in India
  3. Items Reserved for State Trading Enterprises

How we help with Trademark Registration? A detailed Trademark application filing process

Trademark Search
We help in your trademark search by conducting the search using trademark(™) director. We also conduct a detailed check on the trademark logo and brand name that you had selected to ensure that it is not yet registered under anybody else’s name. The trademark can be registered once it is found to be unique. In case your logo or brand name is already registered by someone else, we help you find ways to modify it so that your registration does not get cancelled.

Class Selection
While applying for registration, you need to apply it under the right classification of classes. We help you choose the right class under which you need to register. The trademark offers you the right to sell under a particular brand name within a certain sector in the economy. In total, there are about 45 sectors and each sector is named as a class. Goods and services are classified into 45 different classes by the Trademark Registry. Every logo or brand name has to be registered under the appropriate class. For example, the Class 28 includes products and services related to games, sports and toys. Hence, if you are planning to launch a new toy brand, you will have to apply under the Class 28.

Preparing The Application
After we ensure that your brand name or logo is unique and can be registered, we proceed with the application by preparing the authorization letter first. This gives us the right to make the trademark registration on your behalf. You can sign the letter and return it back to us. We further help you fill out the form and keep updating you about the proceedings until the registration process is complete.

sole proprietorship registration

Sole Proprietorship

Small manufacturers and traders, who typically have just a GST registration, are known as sole proprietors.

Why Should You Register For A Sole Proprietorship?

A Sole Proprietorship provides maximum privacy to its owners and has an easy establishment and operational process

What is a Sole Proprietorship? - Overview

When a business is owned and governed by one person, it is called a sole proprietorship company. This type of business can be incorporated in fifteen days and hence makes it one of the most popular types of business to begin in the unsystematic sector, specifically among merchants and small traders. For a Sole Proprietorship business, registration is not required as it is identified through alternate registrations, such as GST registrations. However, its liability is unlimited and it also doesn’t have perpetual existence.

Benefits of a Sole Proprietorship

  1. Minimum Compliance - Sole Proprietorships have minimum compliance requirements as they are identified by government and tax registrations. Therefore, their agreements are confined to yearly filings of service, sales, or professional taxes.
  2. Simple To Begin - A Sole Proprietorship is simple to begin. One needs to simply have a GST Registration in place. This business can be set up in 15 days with the help of a PAN card.
  3. Economical - When compared to an OPC or One Person Company, a Sole Proprietorship is economical due to its minimum compliance requirements, including no need to hire an auditor. One of the main reasons why small merchants and traders choose this type of companies.

Checklist Items for a Sole Proprietorship Registration

  1. Proprietor Photograph
  2. Proprietor Pan card
  3. Proprietor Adhar card
